Welcome to SWIV. These Terms of Service ("Terms") govern your access to and use of the SWIV mobile application and related services (collectively, the "Service"), operated by SWIV ("SWIV," "we," "us," or "our"). Please read them carefully — by using SWIV, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, accessing, or using SWIV, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service. We may update these Terms from time to time, and your continued use of SWIV after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use SWIV. SWIV is a nightlife application intended for adults of legal age. By using the Service, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into these Terms.

If we learn that a user is under 18, we will terminate their account. You are also responsible for ensuring your use of SWIV complies with the laws of your jurisdiction, including the legal drinking age where you live.

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials confidential and secure.
• Be responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

You may not share your account, impersonate another person, or create an account on behalf of someone else without authorization. We are not liable for any loss arising from your failure to safeguard your account.

4. Location Data Usage

SWIV is a location-based service. With your permission, we collect and use your device's location to:

• Show you nearby bars, venues, and events.
• Display your position on the map and share it with friends during an active night out.
• Automatically check you in at bars via geofencing when you arrive.

Location sharing with friends is only active while you choose to launch a night out, and you can disable location access at any time through your device settings. Disabling location may limit core features of the Service. We handle location data in accordance with our Privacy Policy.

5. User Content

You may submit content to SWIV, including your profile information, photos, username, and check-ins ("User Content"). You retain ownership of your User Content, but you grant SWIV a worldwide, non-exclusive, royalty-free license to host, store, display, and use that content solely to operate and improve the Service.

You represent that you have the rights to any content you submit and that it does not violate the rights of any third party. We may remove User Content that violates these Terms at our discretion.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, stalk, or harm other users.
• Impersonate any person or misrepresent your identity or location.
• Upload content that is illegal, obscene, defamatory, or infringing.
• Attempt to access accounts, data, or systems without authorization.
• Reverse engineer, scrape, or interfere with the Service or its security.
• Use the Service to send spam or unsolicited communications.

Violation of these rules may result in suspension or termination of your account.

7. Privacy Policy

Your privacy matters to us. Our collection and use of personal information, including location and profile data, is described in our Privacy Policy, which is incorporated into these Terms by reference. 8. Notifications

SWIV may send you push notifications, in-app messages, and other communications about activity relevant to you — such as friend requests, check-ins, nudges from your crew, and safety-related alerts. You can manage or disable push notifications through your device settings, though some notifications are integral to the Service's functionality.

9. Third Party Services

SWIV relies on third-party services to operate, including:

• Google Maps — for maps, place data, and geolocation features.
• Supabase — for authentication, database, and storage.
• Expo — for application delivery, updates, and push notifications.

Your use of these services may be subject to their own terms and privacy policies. SWIV is not responsible for the practices, availability, or content of third-party services.

10. Intellectual Property

The Service, including its name, logo, design, software, and all related content (excluding User Content), is owned by SWIV and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use SWIV for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SWIV DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT LOCATION DATA OR VENUE INFORMATION WILL BE ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIV AND ITS OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR ONE HUNDRED U.S. DOLLARS ($100).

13. Alcohol Disclaimer

Drink responsibly. SWIV is a social nightlife app that helps you discover bars and coordinate with friends. SWIV does not sell, serve, or supply alcohol, and we do not encourage excessive or irresponsible drinking.

You are solely responsible for your own conduct and decisions, including any consumption of alcohol. Never drink and drive. Always arrange safe transportation and look out for yourself and your friends. SWIV is not liable for any injury, loss, or harm resulting from alcohol consumption or activities coordinated through the Service.

14. Termination

We may suspend or terminate your access to SWIV at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may delete your account at any time through the app. Upon termination, your right to use the Service ends immediately, and we may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

15. Changes to Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the app. Your continued use of SWIV after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
